Comments: My name is Purushottam Mahajan; presently working for Citibank, my wife’s name is Ujjwala after marriage (Pallavi). She runs a Beauty Parlor at Santosh Nagar, Goreagaon(E), Mumbai, which is a slum area.

The marriage was held on 25April, 1999. From the very beginning there was a difference of values and the attitude towards life. After marriage we had gone to Matheran for Honeymoon and there only she showed her colors….was freely flirting with a son of the hotel owner where we stayed.

My parents live at Dabhadi, Taluka- Malegaon Dist- Nasik .Immediately after marriage she said if you do not take me to Mumbai I will make a big Tamasha….

My mother is a retired Head Mistress of a school at Dabhadi and my father was a Head Master of a school at Dabhadi and now retired as Area Education Officer.

Initially the problem was of hygiene, gross negligence at home; my kitchen was just a dump yard she never use to take care of my son, her only interest was her beauty parlor where she sits with women who always talk very cheap….

Once there was a fight as my son was not doing well in studies and I requested her to come back home once son’s school gets over because after school he remains hungry she keeps him at parlor where he plays in the slum…gutter…mud…because of the fight we together went to a Police Station at Dindoshi, Goregaon, where we met Mr. Suryakant Kharat who was PSI on duty…..I explained him the problem…when he heard about the beauty parlor he took interest in my wife, did not listen to me and did hero giri in front of my wife…Isko Under Kar do kya…..he then gave his mobile number to my wife and taken her number also.

After few days my wife showed me the sms sent by the PSI…said how he is trying to take the advantage of our quarrel….then he started giving calls to her….initially she avoided talking to him…when she showed me the calls I requested her that we should go to his senior officer and complaint…she said why will she complaint?.....he may be useful to her one day….why will I take enmity against him?... The entire world came to know but I was not knowing when she developed the relations with him….My friend saw her on the motor bike with him….the neighbors saw her with him….but I came to know at the last…..when I came to know she started giving threats Kharat can arrest me any time….he can arrest my entire family my aged mother-father brother-sister….then whenever we use to have quarrel she started hitting me….pulling my hair…and tearing my clothes…and giving me threats Kharat can come with Police Jeep and can arrest me….when she started hitting me very badly I told it to my relatives…no one believed….wife can not beat her husband then I met a Lawyer Mrs. Ashumol Kumar…explained her the problem she told me that if no one believes then you will have to record it….because what happens in the four walls, you will not be able to prove and the law protects only women….then I put a DVR, a video recorder. It recorded all the incidents day and night 24hours for 2 months…. Where you can see she beating me every morning I was going to my office and after office the moment I entered the house….though I am a man I was afraid of going home at the end of the day….

I showed the recording to my relatives….they were shocked…the meeting was arranged between her relatives and my relatives where my wife said she is not interested and wants to be a free women…her father demanded 10 lacks rupees and said if this demand is not fulfilled then as you are aware we have good relationship with the Police Department….we know how to get the money….relatives said it is totally a kind of extortion….if you get money then nothing happed if you do not get money then you will file falls complaint to get money…the intervention of the relatives was of no use…wife left my home at her own will brought police to take her belongings…and started living independently….then I filed a divorce petition under cruelty ground in the Family Court at Bandra on 23rd July 08 and as the part of the conspiracy with Karath and a lady PSI Vandana Shirgire my wife gave a written complaint to file a case against me U/S 498A on 8th Aug 2008.

I was called on 20/08/2008 at the Police Station. I went with all the evidence I had showed it to the PSI Vandana Shirgire who is a regular visitor to my wife’s beauty parlor and was taking instructions from Mr. Kharat….the PSI behaved very rudely with me I called my Lawyer Mrs. Ashumol Kumar…the lawyer spoke to the PSI and also with my wife, they demanded 10 Lacks rupees or be prepared for the consequences….the lawyer said make a demand which can be fulfilled…..

Then I met the Senior Police Inspector Mr. Uttam Khairmode (on 21st Aug 08) showed him the video recording and explained him that it is me how is the victim….he called my wife… they had the meeting…the Senior PI said if you take your wife with you there would be no offence registered if you do not take her with you we will file a complaint….I said Sir she left the house on her own…even after looking at these videos where you see how violent my wife is you are asking me to take her home…..then I did 2 things I applied for Anti-cipatory Bail and I met the DCP Mr. Ajit Patil…(on 28th Aug 08) after looking at the videos he said how can they think of filing complaint against you?....he called the Senior PI who was irate with me because I approached his senior and also called the lady PSI and my wife…..he showed the video to my wife she agreed it is she only…then I was told to go…..and the next day the police was suppose to give their say for my anticipatory bail application the lady PSI came with the offence registered.

Initially interim anticipatory bail was granted to me but later the Judge did not see the videos and the divorce petition which was flied before the offence registered …just kept on reading the documents created by the police and I was sent to jail….for 5 days….

After coming out of the Jail I straightaway went to see Teesta Setlwad ….she was not in Mumbai….then I met her husband Mr. Javed Anand… who told me that he knows the Additional Commissioner Mr. Suresh Khopde who is non corrupt and would give justice to me….I prepared presentation spending the entire night and next day met him (on 7th Oct 08). He called Mr. Kharath and the lady PSI Vandan Shirgire (on 10th Oct) and told me to ask few questions to them in front of the Additional Commission both Kharat and Shirgire were unable to give answers to my questions….Mr. Khopde said he can very well see the conspiracy…said we recruit women who are suppose to be sensitive but this lady officer is shameless…he shouted at both of them and said I am taking this case away form Vandana Sirgire at this very moment… told me to meet PI Khadtare give him all the evidence I showed him and they will see that this case gets classified and closed. Now Mr. Khadtare has taken my statement, statement of relatives who witnessed the extortion of Rupees 10 lacks…I have given him all the documents proving that each and every sentence in the FRI is falls ….but I am not sure if he is trying to safe guard PSI Kharat and Vandana Sirgire…So far he has not yet submitted his report to the Additional Commissioner Mr. Suresh Khopde who is due for promotion and may get transferred and then there will be no one to give justice to me….at the moment I am just waiting and watching…

Then she asked for a car for commuting everyday to her fathers office. She is a MBA and is appearing for CA final exams. Was working at her fathers office who is a practicing CA. Then she asked for my entire salary and said that she will give me pocket money. She was pressurizing me to take a flat in Mumbai as she did not want to live with my parents. I agreed on that, but then she said that she will stay in the same larger house and asked me to tell my parents to leave the house as the house is in my name. But it was purchased before marriage.
We were not even on speaking terms after 2 months of marriage. We never had physical relation as she said that she is not ready and will take some time. She never did any work at home and used to raise hues and cry for some or the other thing.
In between on 10th of July she left my home for 2 months. Then came back. took back her jewellery and the jewellery that we had gifted her. We do not know where the jewellery is, but we have taken it in writing that from 4th of Sept, she is responsible for her jewellery and she had kept it in a locker. One fine day she left the hous eon 10th of Oct and on 25th of Oct lodged an FIR saying that,

3. Attempt to murder
4. Threatening to murder
5. Impotency
6. Mental Torture

We hae got bail from the Session Court and she had applied to the high court for cancellation of the bail. Its sheer harassment. The next date of hearing is in January

My Brother Suraj Gupta, married in 2002 , has minor disputes with her wife and then she left our house and went to her parents place. My brother came to England but was emotionally attached to her wife. Then they both started to talk on phone, and on her wife request, my brother decided to come back to India. In the mean time, wife's parents declared him as PO(Proclaim offender) , as case was going against him and he left the country in 2004 for career growth. My brother's mistake was that he did not took permission from court while going abroad. But despite of knowing that he has been declared PO, on her wife's assurance , he came back to resolve all issues and get settled again in India . But as soon as he came back in July 2008, her wife and parents changed their views and got him arrested as PO. Now, high court has rejected his bail for 2 times. He is in Patiala jail for last 4 months without any crime. Wife's parents are not telling what they want exactly. Neither they want compromise, nor they want to do mutual divorce, they just want to harass our family. My brother who was working as an senior accountant in England, left his job just to get her wife back. He was very much attached to her, but not the vice versa. Wife's family created a drama to call my brother back and talked very nicely while he was in England.

Please let me know whats the best suggestion. I am worried my brother can take some wrong step as he is in depression.My parents are in India and dont know what to do . Should we go to supreme court, or is there any other way. Please guide.

Comments: I got married on Jan 2000. I went to USA with my wife on June 2000 for my job. She could not adjust her life in USA & got homesick because of her parents and siblings and hence I was compelled to return back to India (leaving my job) after 3-4 months. Luckily got another job in India on Jan 2001 (after remaining unemployed for around 3 months). Life in India started to turn hell since she wanted me to stay away from my widowed mother and young brother (student). Her parents were key in putting this pressure upon me. I did not pay any heed to this - she left my house on May 2003 and went to her parent's house and ultimately filed 498A on June 2003 against my mother and myself. Later she also filed 406 and came to my house with her father and local police and collected her stridhan (although she mentioned that she did not get the entire things as per the list provided by her). Meanwhile, she also filed maintenance under CrPC 125. In this maintenance case, the lower court judgement was Rs.12000/- per month and when I moved to High Court against this verdict, it was reduced to Rs.10000/- per month. In Aug 2008, she filed enhancement of maintenance u/s 127. This is still pending at the lower court.

My 498A & 406 (both have been filed a separate cases) are pending for trial (to start) since the last couple of years. Being the primary witness, my wife is required to appear in the court as the first witness for trial to begin. But she has been avoiding dates on one pretext or the other (her illness, her family problem, her lawyer's absence etc. etc.). Although she comes to the court on almost all these dates, she does not appear in front of the judge at the court-room (she waits in the lawyer's room in the court). And, if by chance, on any date the judge is absent, she immediately appears for witness by submitting her 'presence petition' (knowing fully well that in judge's absence, her witness cannot start on that day). In other words, she is trying her best to work within the loopholes of the law and dragging the case year-after-year. Although my mother is not required to appear in the case dates (she got relieved u/s 205), I did not get this relief and hence I have to appear on all dates.

This is the current situation in brief.

Comments: My brother's wife left home on 17th April'08 with two small daughters (10 years and 3 years) alongwith her maternal uncle and his son when my brother was not at home and took all jewellary, TC of elder daughter and birth certificate of younger daughter.

She approached Women Cell on 20th April and 5 subsequent meetings happened. In 4th meeting, she asked for 15 lacs to settle amicably which we refused.

In June they filed FIR under 498A and 406 against myself, my brother, father and mother. All except main accused got the bail from session court. Brother got interim bail from High Court CHD. While reporting for bail confirmation, we have returned all the items mentioned in the list submitted by her and agreed by us.

Now my brother's bail confirmation hearing happens every 2-3 months as he is on interim bail. They have also been called to present their case and on every hearing they are insist recovery is not complete. Judge is pushing us to go in for reconciliation, which we initiated directly and opposition supported but it seems they are playing game.

Need advise on further course of action.

She made me clean dining tables while at her house and refused to come along with me for honeymoon and she left my house with her father with out talking to me on 6th day from marriage. And she sent me an SMS if I had married her out of any compulsion and I replied out of frustration stating that I married her out of compulsion. There after her parents came to my house and took all their belongings. After this we attended marraige couseling arranged by my relatives. In the meantime they filed dowry case with police nearer to their house. But the police after investigation registered under IPC 420 and 417. They compelled me for nullity which I refused. We both are IT professionals and now she is not ready for any re-union at the instance of her father. Me and my parents have got AB for 498A sections. FIR was registered for another compliant. They were also demanding compensation of upto 15 laksh. Pls help me on what path should I take for early exit from this marraige. I have also field RCR before the FIR was registered by them. Below are my questions.
1. Is it possible to get mutual divorce within one year. So far there is no sign of it. But ultimately my lawyer has got such a suggestion from my wife's lawyer refering the citation of Delhi HC in Tarun kumar Vaish Vs. Meenakshi Vaish. Pls let me know if there is any such case.
2. I am not willing to withdraw the RCR petition as long as she refuses for re-union in front of the court. Is it right.
3. Should I quash the FIR or should I wait and get that withdrawn by them in case of compromise. She made contradicting statements in the first and second complaint and jurisdiction is also need to ascertained.
4. Should I go to Lok Adalat for compromise or can it be achieved between lawyers. How compromise is achieved in writing. Will the court refer us to Lok Adalat through my RCR petition in case my wife refused any re-union.

My case may not be as grave as others since it is a 6 days old (un-consummated) marraige and there is some mistake on my part with the SMS message. But it has taken away our peace of mind. I appreciate any valuable advise. Pls bear in mind that re-union is deniend by my in-laws and my wife.

She always has suspicious on me. More than 9 years left with so many problems and adjustments by me. One fine night I was thrown out of the house from a rented shared house due to the issue of same doubt. She reported to my company boss through phone and boss is also a Lady. Then I returned to my parents house. She throwed all my belogings like dress, books except some things like computer, printer, ups, Video camera (all is used for my offical purpose and contains my work of total 10 years of exeperience) and one land document whose title is in my name which was purchased only from my salary.
I took so many Personal Loans, purchased house hold articles using my credit cards after marriage. Now even my total salary is not enough to pay back all these dues. My parents only giving support to me.

She FILED CASE IN JUDICIAL MAGISTRTE AND ORDER has been passed in favour of my wife and admitted all her prayers and ordering

1. to pay maintenance of two children Rs. 6000/-monthly
2. to pay one Lakh rupees for her other dues
3. to have custody of children since both are under age of 8 and
female
4. Not to enter into her residence area
5. Not to sell the land (a separate civil appeal can be filed to
have title)

Appeal is made in the District Court. Case is still under progress.

Kindly give advice for the followings

1. Can I have custody of my children without them my life will become miserable. Since I have two children(female one is aged 8 and other one is aged 3) any one if I get, I can live with the rest of life with my child.

2. I want to prove who did violence against whom. I have a record of telephonic conversation between my wife and me which any decent woman will not use those words.

3. Since she is earning more than me, and there is no violence also committed by me, and my loan repayment is more than my salary I could not pay this 6000/-.

4. Till this time I do not have any intention of making any divorce application in the family court since it affects my children in the future.

In spite of no evidence Domestic violence may happen in future

Case Situation: Her stridhan is not with me it is lying in a rented house for nearly 1 yr now, in which we both used to live in Delhi as i was working in one of the BPO then. We both have come to our native place Meerut and living with our respective parents.

We have given girls side couple of legal notices stating please pick up your Stridhan from there as it's your's but they have ignored our requests. Instead they have filled another fake case against us of 406.

Even owner of the house has sent us legal notice stating pick up your stuff from our house (As the rent agreement is on my name)or else he will auction the whole stuff which is lying there and get his rent money out of it which admittably nobody has payed him uptill now.

My question is. Is it advisable to pick up the stuff from owner's house as girls side is hell bent on not picking up there Stridhan from rented house.

Even he tried to be with her separately and there also her mother interfered and ensured that goondas from her side hit him black and blue and complained at ladies police station. In mean time my cousin complained in other police station about hitting him, and police conducted a medical test and till date no action over them. where as Ladies police were planning for arrest and in mean time my cousin & his parents went to court before arrest and asked for help. Court adviced them to be in Judicial custoday and after 2-3 days they are out on bail. Now please advice, what to do. My cousin is still continuing the medical treatment. Police staff had not conducted even an enquiry on beating my cousin.My cousin & his parents are signing in Police station on every sunday.

Comments: Presently, I am abroad.
My wife and I had one compromise for reconsidering to live together in Oct'06 but in vain. Separated again.
Then, I attended Women cell complaint in Jul'07 but the case was closed by my wife since she didnt make me agree to live with her.
Also, I made her to admit in front of Women cell Police that there was no rude behaviour and any money demand from me.
Since she and her family becoming aggresive and abusive towards me, My family decided that i should take an opportunity to study abroad. I quit my good salaried job for higher education during the deadlock period of conflict Fall 2007.
Before leaving India, I filed for divorce with Power of Attorney to my father for that case and any subsequent case.
She filed for maintenance but on submission of my certificate that i am obtaining education, she couldn't get any money.
Now she got 498A registered in Oct'08 again. Due to anticipatory bail of 5 days warning before arrest, no problem to parents but then we couldn't manage regular bail however given interim relief on many hearings. During this interim relief we tried to negotiate with wife's family on appropriate amount for divorce duing many hearings (Divorce case going parallely) but their greed is insatiable.
My attorney applied for regular bail by depositing demand draft equivalet to money estimated from a list in an available diary written by girl in her own handwriting. But, still the regular bail in my 498A case got rejected without any further relief. Now my attorney is planning to apply for bail in High court.

Also advice on myopinion for parents to take a vacation for a week or month and leave the town till the bail acceptance.

Sugget further action plan for our precaution? What section of Laws and cases in attack we can file against girl and her family? (Till this time we just filed Civil case for Divorce)
