This is Jahan and Iam currently in Texas,USA.

She cleaned our joint account by cashing $23000,locker with all her jewellery and flew to India on 08OCT08.

The night before she left,she broke my apartment and took my daughters VIZA and other valuable stuff and filed a 498A againt my whole family.

I filed for divorce a week back when she was in USA and she got served with the divorce petition.

Her whole intention in doing this henious act of 498A is to get me out of USA and withdraw my divorce case in USA.

She has pressed charges which are stupid and cannot be proved.

I know her eveil intentions of creating trouble to my whole family when she and her brother in USA threatened me several times of dire consequences if i dont live upto her expectations of being a money making puppet ignoring my responsibility towards my parents.

I have all the verbal recordings of their threats/abuse,i had to cut my wrist out of frustration.I have sent all the related evidence to my advocate back in India to prove my innosence.I know for sure that i can win the case in India putting my US career at risk.With the rising corruption at every level i have to shredd my hard earned money for no sin of mine.

Comments: I am in abroad at present for job was living with my wife, kid and my parents from sometime.

MY wife has been threatening me and my parents to falsely accuse of dowery harrassment, domestic violence and other false charges so as to create all kind of troubles for us. Her parents , in India, also made several threatening calls to me and my parents and said the same thing.

She has been doing all this do continue her illegitimate relationship with her colleague which had come to my notice few weeks back. I have some evidences to prove her affair.

Later she left our place where we were living together and went to live at our family friend's place. She took our daughter also with her aged 1.5 years. She took most of her belongings including her education certificates, bank details, jewellery , cash etc. Reason for leaving she said was that she needs some time to think over our relationship.

Within a week's time she left their place and went to India with our daughter and her boyfriend to her parents place. She took our daugther to India without my consent and did not allow me to meet her or our daugther before she left for India.

During whole week I had been trying to call her and her parents to discuss the matter with her and her family. I was constantly threatened by them that they frame false charges against me and my parents if I do not keep quite. They also disguised me that she will not return to UK till the time we patch up.
Since she was on my dependent visa here, I applied to Immigration Agency to withdraw my sponsorship for her dependent visa.

However she left our daughter in India and tried to enter the country with her boyfriend as per her mallicious plans and was detained at the airport and was sent back to India. Before leaving she made call to me from airport and said it is an open war now and she will do anything to harrass me and my parents in India.

Now me and my parents are under severe stress due to all this as we anticipate she will be lodging above false complaints. I had been trying to call her and her parents but none of them picks my phone. I am sure that they will harrass us especially my parents who are due to return to india soon and live alone there.

I read SIF and 486a.org but since in Uttar Pradesh there is no Anticipatery Bail provision, I need advise from you on how to protect us from being harrassed and for getting child custory etc. Please also advise some good Lawyers in Dehi and Lucknow to handle the case.

Comments: My wife ran away with the child for Canada to India, all of a sudden. Then her parents who are very influencial and well connected politically, spoke to my parents about reconcilation on the condition that I go and settle in India. But after I went to India, they threatened me and forced me to sign the papers of divorce with no access to my son. Now my wife's parents are pressurizing me to sign the papers of adoption, which I did not sign. But I think they may have already adopted the child since they can manipulate the law to their convinience. Please advice what are my options. Even though the child is abducted from canada, since the decree is already passed with no access to my son, I am worried if anything could be done in this scenario.

Here she was very aggressive & argumentative as always wanted to control relationship. When I did not agree with her she would blackmail by saying that I am now leaing this house & relationship. Then on 8th Oct 2007 she left the house of her own & has not returned till date. In the meanwhile on 12/10/2008 she has filed complaint against me, my parents for Dowry, mental harrasment & domestic violence. We were called by the ACP to file statements which we have done (except my mother as she was not well). We hae filed for anticipatory bail on 24/10/2008.

The incident happened about five months ago. I like to know if I can file a defamation suit against my son's father-in-law; because he is the main culprit. On 4th Oct2008 they have put up a case in my local thana that we are physically and mentally torturing my wife.
The case was transferred to local NGO being run by our local MP(Mrs. Suman Mahato).
Now I and my family is worried that what should we do now? The main problem is that my son is only three years old and I want to have the custody of the child if divorce takes place.

But she does not cme & give the complaint to the "Mahila Ayog" then in my company family councile also. She was demanding that 50% salary & for residing house. I denied because that time my RCR 9 was going on & both children along with me.
She is continuously giving the letter to the Mahila Thanna, DIG, SP every where. I met with all the people give y opinion & they understood i am innocance so no action has taken by them. So she approached to the politician also.
In the mean tine she has charged me 151 & got arrest on that & 24hrs i was in lockup. So i have taken beck my RCR 9 she has taken beck my children with the pressure of Police. So i applied Divorce case &gone to the parents house. When after 4-5 days i came beck then i saw that my In Laws & my wife entered in my house by breaking of lock. I immidiately compalaint to the Police & after some tme i have given the complaint letter for taking beck og my valubale documents, ATM card, Passbook etc. But she denied to Police also for giving me.
Then i filed complaint case on Jannnuary 2007, under sec. 406. Then this case also registered in crimnal court. When arrest warrant come out for the name of my wife & My in laws then she put 498A case on me & my parents. She is applied on 22nd may 2008 & they have arrested me on 24 May morning 6am without any investigation with us.
I have given all the document proof so i & my parnts immidiately got bail. Now the case is in court & first evidence on 25OCT 2008 mean this Month.
I have never beaten her also she does not have any medical report no other police report before 2006. She unncessarily harrassing me mentally, Physically & financial. I think, i am eligible foe 498A case to my wife but that law is ment for on ladies so they are misusing it.
So please give me help & provide advice to me also.

Comments: Family due to social background preferred mutual divorce for which she initially asked and agreed at 10 lacs after taking 2 lacs in advance she refused and demanded more. Finally settled at 13 lacs to be shared by all members named in bogus complaint, paid another 1 lac at the time of signing agreement and before filing divorce papers. On 1st hearing she asked for more money and threatened to sent all jail immediately if more is not paid. Got another 4.5 and after that never turned back and refused to give divorce.

One goonda element was involved in the negotiation from their side bec of which we agreed for mutual divorce by paying money. She many time told my relatives that if they don't pay her I may met with an accident while going office and after me all will be of children and children are with her.
Living with parents and working in Rewari since 26.3.2006. When I tried to meet my sons her brother resisted and claimed that he is the father of them and I'm impotent. I'm unaware of reality but surely I'm not impotent, though may not be able to meet her prolonged and wild desire for sex.

Now again we are being threatened for consequences of i file divorce. I have not been allowed to meet my sons for very long.

No further action taken by me till date.
Presently I'm transferred to Jaipur. Marriage was solemnized at Rewari and we lived together in Rajasthan. All period was disturbed. I never got respect from her or her family(my in-laws).

Mutual consent case was filed at Delhi as at that time I was posted in Delhi. Can case now be filed in Jaipur or it has to be filed in GGN????

For want of separate matrimonial house only, the false complaint are made. We accept to set up a separate matrimonial house and get two months time for setting up of separate matrimonial house. I am BL Graduate. I can't anything. Because the complaint was made against the three innocent i.e. my elder sister, father and monther. We are suffering lot for the last one month, without doing anything against them. They bind me by making false complaint against my elder sister, father and monther. Sir, Is any way to help the innocent like my elder sister, father and monther. Because of selfishness only, the laws in favour of Women were mistakenly handled by Police Officials. My family members calmed her down and called her father in the morning by phone.. where her father asked us for frogiveness on her daughters behalf and told us that " if u want to throw her out from the house I will accept the divorce" which was very strange to us. by speaking to her the matter was settled.. Since I am a marine engineer I have to sail for 6 months..in 3 yrs of marriage she has stayed in my house for not more than 3 months and always brought her mother. we looked into this behaviour as normal she being the only child. after a year a daughter was born. After the childs birth she refused to come to my house at all.meanwhile her mother started to force me to pay her daughter 60000 rs per month.which I refused to pay. I was giving her 10000 every month. last year I went for my exams to the UK. I went along with my wife daughter and brother. after 2 months stay I sent them back with my brother. after her arrival from the uk she went to her house with my daughter. her mom them started threating me to give more money to her daughter or face dire consequences. this infurated me and I reduced the money to 5000. then she started threatning my family with 498. I have filed a restitution of conjugal rights. on reply they have filed for divorce bringing dowry,torture allegation against my mom,and sexual abuse against my brother. The court has given them a maintenance of 10000. but she has appealed to the court that she be given 60000 evry month.still to hear from the court. meanwhile I have filed for seeing rights of my daughter..do not know how and where this case will end please help.
