Not even once did she thought that my father who is 70 year of age is a heart patient and my sister as a 10 year old son to support. Comments: I work for a middle level management position in a reputed Private sector Life Insurance Sector. My wife is an MCA graduate and works for a reputed MNC software company in Chennai. I got married mid-january 2005 and we stayed with my parents in my hometown till may 2005 and after this we moved to Cochin, where i was transfered and my wife picked up her first employment.Six months after my marraige my wife started picking up quarrels saying that i have an affair with one of my old collegue at work.In march 2006, I resigned from the existing company and joined a new company at coimbatore where as my wife opted to stay in a working womens hostel in Cochin.In the month of November 2006 I got a promotion and moved over to Trichy. This was just a stop gap arrangement as the company informed me that i will be shifted to chennai in April 2007 for handling greater responsibilities. I explained this to my wife and advised her to continue with her career, as she had a great future to look out when we move to Chennai. During this entire process, her understanding was that,I was flirting around with my collegue and that is the reason,I was not allowing her to stay with me. My sincere intention was to get her into a good career path. Her parents startetd warning me in 2006 June itself that he will file a case for harrassment as i am not taking a house and living with my wife.
Finally in August 2007,i moved to Chennai along with my wife and we started staying together and she also took up a job with a reputed MNC software company.
All throughout this period, she use to costantly pick up quarrels accusing me of having affair with the collegue i mentioned above. She along with her parents go to the extent of taking out my itemised mobile bills illegally from service providers, hack into my emails ids etc. I fact when i have asked her father for proofs of my alleged affair - he admits that its only a suspicion. in the meantime, their parents and relatives have gone several times to my parents residence in ooty(where they lead a quite retired life)and have abused and threatened them with filing 498a DV act cases against us.
Her father is a retired co-operative bank manager and a full trime CPM party activist in kerala. her mother is a retired school teacher and my wife is their only daughter.regarding my wife's background - she is a compilsive mobile and a TV/Movie addict. All her immediate close friends are divorcees and her mobile usagae is such that she contacts only men whom she claims as good friends.
Thing took a bad turn in Jan 2008 where she claimed that I was staying with my ex-collegue where as i was on official tour. Claiming so, she left my house and went to stay in a working womens hostel along with her friend. Personally, i decided to call it a day and end this relationship and told her parents that because of this constant torture, i am not interested in continuing this relationship. After a week she came back to my house stating that she will move out from the house after she gets a suitable accommodation. in April 2008 their family members invited us to their relatives house for a future course of action and the situation turned volatile and my parents along with my uncle where abused brutally. Her father pointed out that he wants all the jewels back brought by my wife and given to my parents safe custody.
On Aug 15th my wife came to my parents house demanding for the jewels. i returned back all the jewels by getting all the details mentioned along with the weight with all necessaary legal conditions mentioning that she does not have any futher claims for the jewels and everything has been handed over to her in the presence of witnesses on a rs.50 stamp paper.
on August 8th she left my home for good to stay in a paying guest accomodation in the same city. On august 16th two cops came to my parents house in ooty and informed us through a notice that her father has filed a complaint for dowry and physical harrassment and myself along with my parent are required to appear before the DySP at Shoranur in his office on 21-sep-08. I sent a telegram to the DySp on the said date stating my father is ill and I am taking him for treatment ( the fact is that my dad has undergone a bypass surgery 8 yrs back and is 70 yrs old). On the said day, the DySP called me over my cell-phone and threatened me saying that he will charge the case. The ASI of the police station has also called me twice and asked me when i will come next. I have asked for 15 days time and in the meanwhile i have shifted my parents to an undisclosed destination. I have been on tours and just today landed in station in my office.
In the meanwhile, my lawyer has sent a RCR notice to her and copies to all the police officials of the two states.My lawyer states that based on the notice, he will advise to file a divorce case.
I have also caught some people with political connection and in the police and the information I get is that, they want to fix up a heavy settlemnt in conniviance with the police and the local CPM party.
hence i fear:-

Kindly let me know the procedure to get an AB even if the chargesheet has not been filed.

Comments: Sir, Im a naval personnel posted in Vizag now. married on 25 Apr 08 and on next day of our reception party(first Wedding night, 27 Apr)on 28 Apr morning she left my house with their parents blaming me chit and i have sexually harrassed her throughout the night as she mentioned in the FIR. Her Mother, Father and my wife made a great hangama infront of our door. To see the critical situation we lodged a complaint same time at police station. Police came and made the situation under control. She left my house with parents alongwith all her all the ornaments. A case under IPC 498a and IPC 125(for maintenance interim Rs. 4000/- & Rs. 6000/-)lodged after one and half month against me making 12 family member accused. Police raded at about 0200 hrs in the night and arrested 03 members, got bail on next very day and rest of the members including me got bail after surrendered at the court. The date of hearing for the maintenance case is in Mid Nov. I dont know how to get rid of it and what will happen, most of the advisor says there is no way, lower court gives decree to womens favour in almost all the cases. I have my old parents with me, in a limited salary in Defece force how to run my family and fight this war if requir to pay 6000/- every month. Request help .........

Comments: The marriage of the couple took place 13 years back and bare minimum articles were given as dowry to the wife. The couple has no children as the wife a medical problems related to thyroid malfunction, PCOD, over weight etc. A lot of medical treatment has been undertaken but of no use as she is not able to reduce her weight which is said to be cause of her PCOD conditions. Further her parents had been ever interferring in the married life of the couple. The younger brother of the wife had stayed with them for 7 years during his education. The husband even gave money to the brother for meeting his day to day expenditure and did not ask anything from his inlaws. Further, the parents of the boy sold their anecestral property and built a new house and the parents of the girl wanted that half of the property should be in the name of the girl so that by doing this the love and affection between the couple would increase. Everything went well till the death of boy's father. The boy in question has three sisters who are married and are very elder to the boy. They gave their legal rights in the property to the boy and the whole property was transferred in the name of the boy. Then the problem began. The girl would not allow any phone call or visit by the sisters of the boy to meet the old mother (84 years old) who is having impaired hearing/eyesight.
Yet another incident in the family of the girl happened. This incident relates to the younger sister of the girl. This incident happened a few months after the mariage of the couple. This sister of the girl was involved in an affair with a boy, who was called by the parents of the girl to finalise their marriage but was murdered by giving him poison and a case under section 302 of the CrPC was got registered involving the father, mother and the girl. However, due to the legal battles the girl's father was convicted under the section 306 and was awarded 3 years RI alongwith a fine of Rs. 50,000/-.
Due to this incident the old parents of the boy, whose wife has lodged a complaint with the police involving him in 498A, were always worried about their well being as well as the well being of their son. They feared that if they ever opened their mouth against the ill doings of their daughter-in-law then they would also meet the same end as the boy who was given poision and murdered.
The parents-in-law of the boy in question always threatened the family that they have committed the murder and yet the law could not do anything and they are roaming scot free. These utterances always demoralised the old parents.
Now the girl in question has given a complaint in the women cell implicating the husband and two sisters: i) under 498 A for asking dowry; ii) manhandling; iii) withdrawing of Rs. 1.5 lakhs to Rs. 2 Lakhs fraudulantly from the credit card.
These allegations are the creations of the wicked mind of the girl, her parents. The police is now pressuring the boy and the family to take back the girl which the boy does not feel to do so. The negotiations are going on and the girl is sticking to the fact that she now wants to settle down with the boy. The family of the boy is fearing that if she comes back then same things would be repeated and they would be tortured more than ever before. Moreover, if the girl commits any of the offence like suicide, or hurting herself then the boy, the old mother and the sisters would again have to face the music of the police and the law.
Please advice. The boy wants a divorce. How to proceed further. The case is still with the women cell. Another fact which is important is that the wife of the investigating officer is the colleague of the wife i.e. working in the same organisation due to which the investigating officer is biased and says that he cannot keep the case on hold for long time. The relatives of the boy have visited the girl's family inorder to show to the police that the negotiations are going on. The next date is on 6th October 2008, please advice.

my FIR is registered, i have one Domestic Voilence order which is in my favour (case was dismissed), obtained Anticipatory bail.

Comments: i got married last year january. just within few days my wife and in laws started pressurising to listen whatever they say, depart from parents and setup a seperate family. i apposed the same from beginning and they started threatening me with their relatives and some goondas. Inspite of their threats we tried to negotiate with them many times but failed to change their attitude. finally now they have filed a 498a case against me and my parents. we somehow came to know the thing and escaped from the arrest. we have requested for a bail now. we are undergoing a painful situation. could you please suggest me how should i proceed in this situation.

Comments: we got married on 5-10-2006. after marriage we were staying with my parents. There use to be a generation gap. there used to be arguments all the while. I used to support her and even fought with my parents. 1.Husband under the influence of parents demand dowry.(In marriage/after marriage no dowry demanded except customary cloths(3 pants,3 shirts,1 suit,1 neck tie /1 wrist watch/1 gold chain/1 gold bangle undersize as i did not give them the size as i did not wanted that)
2.Demand Aircon & washing Machine.

Comments: Facts of the case
1.My has deserted me on 18.6.2007 and to my daugheter with her on the prestext that she does not want to live with a 'salaried person' and she wanted to marry another man .. a rich business man , with whom she will be happy.
2. Several times since my marriage she has told me and my family members and relatives that she was forced to marry me. Actually she was in love with a guy called Rahul.
3. In the course of my career I had taken up jobs in Himachal Pradesh, Ahmedabad and Bangalore before coming to Join Tatas in Jamshedpur in 2001. Her relatives are all from Jharkhand. Taking undue advantage of this vicinity my wife was 'instructed by MIL to be very aggressive with me, esp on our sexual relationship. In 2005 she ran away with the daughter and called up all my relatives and told that since my penis size was small she was not satisfied.That this child was not mine.The matter went to the familt court where it was quashed. But MIL went on pressing for a divorce and demanded immediate payment of 80 lakhs !! After the case was quashed, she returned to me. But she became very aggressive and brutal towards me.
Her relatives were keeping a tab on our relationships and went by the version she 'told' to them on phone while I was at office.
4.On April 20 2007, I bashed up my right shoulder and was on leave for 52 days. Duringthat period she tortured me mentally, physically and crossed all the limits of brutality. She stopped cooking for me and also forced me to sleep in another room to avoid any sexual relationship. She demanded hefty amounts towards household expenses and personal expenses.When I questioned her on where she spends all that hard earned money, I was surprised to know that 90% of the Rs. 10000 she used to get from me was being siphoned off to her two unemployed brothers and to her brothers, without my consent.
She had several boy friends who used to call her on her mobile and crack dirty jokes. One day I overheard her talking to Rahul about sleeping with him while I was in office. When I objected, she threatened to 'Tumko Barbad Kar Denge", and"Tumhara sara khandan sadak per la denge" etc.
5. Scared of her intentions I informed my parents at Patna and joined a bacheleors mess for food. I was still ailing when she announced that she had "some urgent work at Bokaro with her uncle" , so she is leaving on May 22nd. Leaving me to fend for myself with a broken hand, she went away with the child and returned on June 16, 2007.
6. June 18 afternoon around 3:00 PM she again ran away with the daughter and this time took away all the jwellery items and other valuables with her. In the evening my MIL called my up and said that she is in Ranchi and that I should forget them now forever. She also falsely alleged me of domestic violence.
7. June 19 I filed a information in the telco police station in which I narrated the whole incident and informd the SHO that my wife and daughter wre with my MIL at Ranchi.
8. In July 2007 they sent a 34 pages long list of demands (unsigned photocopy) along with wild accusations on me and my family, especially targetted my father for his immovable property in Patna.
9. Several negotiation meetings for a mutual divorce u/s 13 B were conducted. It was decided at length to pay a sum Rs. 5 lakhs as alimony and the child would be in the custody of either parent.
According the petition was drafted and sent to the wife.
10. They kept silent for about 2 months and in the last month i.e. Aug 2008 they started calling up my elder sister and my advocate for the following :
a) The money shuld be given to them as DD at the time of the signing of the mutual divorce petition and not after the hon'ble court awards the divorce decree u/s sec 13 B/. They will not give any receipt of the same.
b) They do not want to give the custody of the child to me.
If we do not agree to their terms they will lodge false cases u/s 498A and DV etc. on me and my relatives.we did not agree to their terms.
11. On 7.9.2008 they approached my advocate at Ranchi and pressurised him to expunge those clauses from the divorce petition otherwise they will file false cases at Dhanbad.They also threatened to book me under 498A, DV act and attempt to murder.Meanwhile the Allahabad high court ruled in a similar case that even after mutual divorce the greedy wife appealed before the court that she was forced to sign the mutual petition and demanded mainenance u/s 125 even after a one time payment made to her by the husband as alimony. The court decided in faovour of the wife.
MY questions :
1. Can we file a case of extortion, blackmailing and coercion on my in-laws to put an end to their threats to file 498A and DV on me ? If so, what is the process ?What documents will be needed to support me if there is a contest?
2. Can I file an RCR before they actually file a 498A case ? Will my first move weaken their claims and help me in quashing their case.
3. What should be the correct way to handle the child custody issue ? My daughter is 13 now. What caveat petition has to be filed to prevent them from pitting my daughter against me through an affidavit stating that she was an eye witness to the domestic violence.
4. What cases I should lodge against my MIL and BILs to prevent them from becoming hotile witnesses in the court ?

Comments: I'm only male child of my parents. Got married on 10.10.97 ,at faridabad which is my native place, whereas she belonged to Panchkula.
Blessed with Baby boy 7.6.99 at Faridabad, now he is 9 years old
She was not happy with parents,donot want to do any household work, used to nag with me as well, as she was very suspicious about my character, separated from parents in May 2002, moved in a rented space.
Moved to Bhopal in Aug. 02, due to job responsibilities with Wife and Kid. Stayed there till Jul. 05. However no change in attitude towards me and my parents.
Joined another company at Gurgaon and started living there only.
she started pressurizing to buy Car initially then for a house (Which I could not afford) and finally to join her sister and BIL at Newzealand (which I resisted). Got passport made however.
She went on to Panchkula to meet her relatives who had come from Newzealand, on 11th Oct. 06 and rather than coming back home filed 125 CRPC from Panchkula. I filed Sec. 9 from Gurgaon. She filed transfer of Section 9 at Punjab Haryana High Court.
Matter comprised at Panchkula Court in 125CRPC trial on 30 Mar. 07, wherein she, myself and her and my father gave declarations.
Brought family back in April 07 and started afresh separately from Parents with wife and kid (Faridabad Sec. 49)
She picked quarrel on 18th Jan 08 and hit me in abdomen, got treated in Pvt. Hospital. Forced me to allow her parents to join us our residence, to which I refused.
On 25 jan filed police complaint that I beated her and went to parents with kid without informing me.
On 29th Jan her relatives came to Police Chowki Sec.49 and didnot settle for compromise and got 107/151 registered. arrested and got bail next day i.e. 30th.
As soon as I was free got call from CAW panchkula to appear there as she filed complaint there as well.
Met CAW and her relatives on 15th Feb. 08, wherein she refused to comeback. Next date fixed for 21st Feb. 08. Which I didnot attend.
I Filed Divorce at Faridabad on 1st Mar. 08. where as 498A registered at Panchkula on 28th Feb. 08. wherein my relatives (Parents, Sister and BIL) also booked.
On 1st Apr., sent her articles back thru' transport and in the evening Police from Panchkula arrested me. Remained behind bars for next 7 days and released on 8th Apr.
She moved again transfer application for Divorce at High Court and didnot appear even once at Faridabad. This case went in my favour as ex-parte evidence. However date of transfer application is 21st Sep. 08.
During the investigation, the names of my relatives were removed. However I'm still undergoing the trauma of 498A.
I've already moved an application at High Court to quash the the above proceedings, as no cause of action arises at Panchkula
Please suggest how to proceed further.

Comments: Wife's Education Level 10th Pass only(you don't have this option / less than this option)Our marriage was an arranged one, on 27.11.1977. She was arrogant and insolent since that time. I am Central Govt. Employee, highly transferable job. She stayed with me for years with lot of disgruntlement and absolute intolerance towards my parents and relatives. We had children, a daughter and a son. She instilled her nature in the children, especially our daughter. She never hesitated to use filthy and vulgar aspersions towards me and my Mother, though she had never stayed with her in-laws for more than 15 days at a stretch, i.e. when we went to my home town on leave once in a year or two years. In spite of her acrid nature I never became violent to her. She accompanied me overseas in GOI Service. Returned in 2000. My Wife started showing terrible indignation towards me as my earnings dropped. Still I Raised daughter to MBA and she earns a lot in Media service(since 2004).She bought her own flat and car and pedigree dog etc.. She was splurging on her mother and brother. At the same time daughter's turn-out was not commensurate with the ethics and values of Middle Class family of my social standard. She commenced defying my role as father and a husband of my own dwelling and inciting her mother that "Papa can't take care of you the way now I can care for you." Daughter was taking her mother to Maurya Sheraton for dinner, Lands End for breakfast, to KIA Shop for Diamonds, Metro for shoes, so on and so forth. Gradually I was ostracized in my own house. During this period Son was studying BE(Mech)in MIET Gondia.(I took bank loan to fund his study). I was unaware of the fact that the Mother Daughter duo was planning to abandon me. In April 2006 while I was out of Mumbai for 12/15 days the Mother daughter duo removed all my ancestral gold ornaments, along with her stree dhan ornaments, lot of household articles, domestic appliances and a land property deed which I had bought in her name on the date of our marriage anniversary in 2001, into my Daughter's flat in Hiranandani Estate Thane, When I stumbled upon the fact and raised serious objection, they packed up rest of the things of their personal use and dashed off to my daughter's flat on 27th May 2006. Since that date my wife walked out of my dwelling and life and lodged herself in our Daughter's flat at Hirandani Estate in Thane. I persuaded her to see reasons and come back to her marital home with full esteem but my wife did not pay heed to it and snapped all contact with me. In the mean time the mother daughter duo managed to brain-wash my son and take him in their stride. As a result I sent an Advocate's notice in October,2006. In reply, she (with the financial support of my daughter)lodged a case of separation in Family Court Bandra through a High Court Lawyer on 27th November 2006.The made my son as a party to the case while keeping my daughter out of the case. When I got the summon along with copy of her petition, I was astonished to find that she has converted an incident of her slip in the bathroom in Novemner 2005 and getting injury in her hand into a case of domestic violence against me lodged a police complaint in Ghatkopar P.S. (The police had recorede a N.C. Complaint only, without any investigation). Also she included cruelty against her by my mother and snatching away her stree dhan soon after her marriage and cruelty all along the years of our conjugal life. By grace of God I have submitted ample proof to substantiate that her complaints are false and got my son's name struck off this case by court's decree. Now, her advocate, is deliberately subverting substantiating her client's charges against me and submitting her affidavit for argument and cross examination of the parties, by petitioning time and again, plotting for arguments out of context, that I have hidden money in various banks which I am not disclosing and I have hidden property and on the basis of which his client (my wife) should get higher interim than what (Rs. 5000/-) the court has already decided and passed order in that effect. I am a class III non-gazetted Central Govt. Servant with a take home salary of Rs.17,000/- (salary slip given to court)I have my octogenarian widow and handicapped mother to take care of (normal living expenses plus medicare- unreimbursible). I have a legal liability of Rs 11,000/- HBA EMI entered into before my wife's separation and lodging this false case against me. The petitioner and her advocate dares to claim just for heck of stalling the proceeding, without substantial proof,that my mother earns quite a handsome amount as widow pension and liberal medical reimbursement so my mother's material and financial responsibility on me should not be taken into consideration!!(For my wife, putting up with in-laws is a mental torture.) The fact is, my mother's pension is only Rs.3172/- inclusive of Rs.100/- towards monthly medical expenses, whereas her medical expenses only tantamount to Rs.900/- to 1500/- p.m. I want exemplary punishment for such unscrupulous wives and more stringent punishment for the lawyers/advocates who are helping to break families.
