Comments: I have been married under the Muslim Marriage Act to SAARRAH IMTIAZ who had converted to Islam before marriage and changed her name as above from Sona Hamirwasia. She had told me that she had the consent of her faily to marry me.

After the marriage the family including her father, mother and younger sister, had extorted sums of money from me and gifts and articles which I had brought for my wofe by all three and there has been extremen pressure in instigating my wife against me by emotionally backmailng her continusly.

My repeated interentions and urges for them to stop the misuse and but to no avail. We have a daughter wh is 10 months ld and my wife has run away with my daughter and is now staying with her parents from 13/03/1008. She has written to the Local Police Station complaining against me but no case is regisered yet and her mother has complained to the West Bengal Womens Commission. The Wb Commiaaion has caled me for a hearing on 7th August.

I want a solution to this matter, but I do not want any connection with her family if they continue the same way

Comments: On 22Oct 2006 wife left the matrimonial home with a promise to come back but didnot come back till date.In January 2007 she became abusive on phone and charged him of falsely of dowry harassment.Then immediately I sent advance information to DGP haryana and CP delhion 4.02.2007expressing apprehension of being implicated in a false dowry harassment case.The DGP Haryana Police ordered enquiry thru SP Panipat and sought explanation from her during last week of Feb 2007.On 24.10.2007 the matter was amicably settled and the agreement was signed by 5 persons out of which two were the relatives from both sides and one mediator.Paties agreed to settle their dispute by way of decree of divorce by mutual consent.Unfortunately the agreement could not be signed by the husband and wife.After this the girl's family didnot respond for a long time.Then the husband filed the divorce petition on 01-05-2008 and on 23-05-2008 I filed a criminal complaint against wife and her relatives.As a counterblast to the legal notice of the divorce case the wife filed a FIR for 498A and 406 on 11 June-07.on 17-June-08 I and my relatives went to DSP office Panipat .There instead of investigation we were asked to compromise with the girl's family and gave us 5 days for that.On 20-06-08 I filed for anticipatory bail in delhi and the judge issued notice to panipat police to appear on 28.06.08 and on that day anticipatory bail was rejected on the basis of jurisdictionand police lied that we didnot join investigation .Then My lawyer approached Delhi High Court for FIR Quash,FIR Transfer and anticipatory bail but the judge again gave notice to haryana police to appear on 07.08.08 and also didnot provide stay over arrest.and On 25-07-08 the haryana police came and arrested me and took me on remand for 3 days.and we had to give took girl's things and the jewellery gifted to my family by them and then only I got bail.Please Advice what should be done now????

From 4th day of our marriage I observed some abnormality/ strange behavior in her, which I noticed to her parents as well as my parent also immediately. But her parents denied and didn’t allow me to consult with doctor.

I personally consulted with a psychiatrist and after listening and observing her nature the doctor confirmed her as a mentally retarded. With this she cud not maintain the family life, always she used to do argument, quarrel, and the most is her habitual lies, she tells lies each and every moment, to make one thing is correct she tells lies and then she tried to make the lies thing in truth again she tell lies.

The enclosed chronology of her activities demonstrates the effectiveness of her mental problems ,which I described in my mail dated 2nd july,5th july ,8th july 2007 to her father, that has deprived me of all recourse, remedy, or hope of rescue.

My letter and telephonic conversation to her father was not acted upon, despite the fact that my complaint against my wife and her activities.

I was thrown out from my own house under true or false
allegations that are dependent on him are bound to suffer. That will
include dependent parents and siblings. Unfair
is a subtle word to describe a situation in which me along with my family, is tortured by her and her family.

On 3rd November 2007 at 4.30pm I called her from my office work that one urgent fax will come, I asked her to inform me soon after receiving the same.
At 6.30 pm she called me and told that no fax has come but she received one letter from courier service. At 8.30 pm I came back home and seen that the telephone is not working and all my computers, fax machines electrical connection (plugs) has been misplaced. I asked her about these and she denied that she did not do anything.

I saw behind the computer table that, all the telephone wires, computer speaker’s wires has been cut by a knife. I shown her and then she agreed and replied that she do not want to keep in touch with her parents that’s why she cutted the telephone lines and others.

It is dangerous, if a woman cut the electrical wire by knife, she may cut her body parts or she may attack me to murder or anything she can do.
By seeing her nature I was scared and consulted with my parents, the doctor, my other relatives and friends, they advised me to leave her at her parents place.

Immediately I booked bus (Vizag - Kolkata) ticket and handed over to her father on 7th November 2007 and I came back to Vizag.

there was no contact with my wife since last 6 months, her father talked to my mother and invited me on the occassion of Jamai shahti on june 11th 2008, i went there to bring back my wife with posyive attitude,but unfortunately she didnt changed her self.more over its became worseter than worst.

now she is with me,and giving treathning of her father every moment.

i consulted with doctor of a govt. mental hospital, after counseling her doctor said that her intelligence is like 10-12 years kid, but not metaly retarded. that is why her beahvier is like kid, and she has much anger anf for that doctor given 14 days medicin which she didnt completed.
her parents threatning also.

still i am having positive attitude and teaching her regularly . i lost my job,cant concentrate on my profession, lost money , dnt have money to eat now.

i didnt take any dowry from her father, he has given bed, almirah ,tv set altogether 54000/- only.

now i am thinking for separation,is it possible ? can the lack of intelligence a ground for separation.
they will not leave me.they all are great lier.
her parnet know very well that their daughter having so much anger and etc.. they keep hiden this .......

Comments: wife of vinay left at her own. then she approached Mahila Aayog at Nanakpura, delhi. Here we the family of vinay were ready to accept her back and vinay was ready to live with her away from his parents and brothers or we offered her to take back her stridhan and other expenses and divorce on mutual basis. Even the IO Kusumlata was satisfied with our arguments. But the father of archana vinay's wife refused and insisted to lodge a case in Court. Our statement at mahila aayog support these. IO could not do anything, she tried to convence archana's father but in vain.
then we went to an advocate. He advised to take anticipatery bail. We agreed. He charged Rs 10000/ and gave us an order which says that the Police will not arrest upto 3 days of filing FIR. But it was not an anticipatery bail. He also filed an case against Archana to bring her back. But he again demanded rs.17000/- to continue the case. we were unable to arrange that money. He left the case. On the date of hearing Hon'ble judge understood our financial condition and she arranged for free legal aid. The case is still on and the next hearing is on 07/08/2008.
Meanwhile the bride family lodged FIR and Police came at 5'o clock in the morning to arrest our family. But because we had the court order to not arrest for three days so the police returned without arrest.
The bride family filed an case in patiyala house . We were provided another advocate in patiyala house. But he was very uncooperative. He not took interest in the case and even took money for making document and taking a copy of FIR from Police Station. IT WAS SHOCKING IN FIR THAT IN MAHILA AAYOG ONLY PARENTS AND VINAY WERE MADE ACCUSED BUT IN FIR NAME OF ELDER AND YOUNGER BROTHERS WERE ALSO INCLUDED. We anyhow arranged money and hired another private advocate mr chitranjan Hatti to handle the case properly. but mr hatti made us fool. He could not get us bail even in 15-20 days despite charging rs 15000/-.
Police again come at 4'o clock in morning of 26/07/08 and arrested Vinay. The advocate Hatti again could not get us bail and vinay sent to Tihar Jail and we are escaping here and there to avoid arrest.
Now we dont have money to hire advocates. Vinay is surrering for his innocence. He has been a Peon on contract basis with a contractor. Now he has lost his job and suffering in jail.
May I request you to please advise us what to do. How we can save ourselfs fron going jail. If we had killed Archana we would have been surrering the same or less. we are broken by Indian Law.
I sunil and my father are both gobvt employee. My mother land vinay have never did a crime then why not give us bail and allow us to put our view freely.

Right from day one she humiliated me abused me and sometimes used to beat me.Situation became worse when she started working for a higher salary than me in a call centre.On 22-6-08 in the night over a small issue,she besat me and when I resisted bit me on my lt shoulder and abused me.She called her parents and they came and took her back to their place at Mysore.She filed a case under 498A ,34cpc and using the influence with the police commissioner arrested me and my old parents - at Hyderabad and took us to Mysore.She wanted a sum of Rs`50,0000/- for withdrawl of the`case which we could never afford.We had to spend three days in Jail.After getting bail for all of us we came back now living under constant fear of what would happen to us. We being highly educated and respected family in Hyderabad, did not take even asingle paisa as dowry.on the other hand we provided her with separate accomodation since she did not wantto live with my parents,paid for her MBA studies and bought scooter for her. and fed her for the last 8 years since she would not do any cooking.She used to constantly threaten us with filing 498A if she we did not give in to her demands.
We have engaged a lawyer in mysore and going for our first hearing on 26th July.
My both parents are doctor nad scientist and this case has resulted in to untold mental physical suffering they are still under shock

My wife has been staying separately for more than 3 years or so. No contacts have been made till now except for when she filed case in Womens cell in Delhi and Navi Mumbai. Fortunately case was not registered anywhere and matter was closed by the cell in both places. I attended both the cells and gave my statements , Police found nothing in the case. The uncle who I believe is real culprit demands money every now and then but for the past 6 months or so no communication is there. She filed divorce case in Thnae court, hearing yet to begin since its a year now. In retaliation I filed a criminal case in Navi Mumbai court against her uncle, her and her 2 sisters who also demanded money from me , summon may be issued in next date.

The point is that the house is in joint name, I am second holder.The uncle is a useless chap and is illeterate when it comes to law. She nor her lawyers appear in court any time be it the Thane court ( divorce ) or the Criminal court. The Police has submitted the enquiry in criminal court ( Sec 202 ) where Police has found that case can be registered under various sections of IPC against my wife and uncle along with 2 sisters.

I need advice as following :

1) If she continues to avoid coming to her court nor her lawyers come, is there any way I can apply for ex parte divorce ???

2) What is the best way in this situation i should do?? Please advice.

I, my wife and our child(3 yrs) recently recieved British citizenship. I am the only one with OCI as well. Due to time constraints my wife and our child had to apply for visit visa to india. We thought that they can apply for OCI once we come back from India(Hyderabad). My dad was due to under go a surgery soon in india i had to be there.

I have not been speaking to my wife's parents for a while for the disrespect they have shown for my parents. My wife has always been a good supporter of her parents even for any bad deeds.

During our stay in hyderabad at my parents place, she wanted to visit her parents for second time and i did not allow her to take our child along on that occassion. Her parents turned up next day and had sweet conversation with me and assured me that my wife will return 3 days before our journey back to UK and took my child along.

I waited and she did not turn up, when i phoned she started threatning of filing a 498a against me and give up british citizenship as well unless i help her father in finding a NRI groom(as he needs to get 2 younger daughters married to well settled persons), and also ask an apology to her family members for not maintaining good relationship. I being short tempered, refused to do so. I came back to UK as had to join back at work(i already took 45 days off) and was already on unpaid leave for couple of days. Return tickets for my child and wife were wasted.

My parents back in India are worried of getting arrested any time, in case she files a 498a. Now am alone in UK, missing my daughter, extreme financial deficit(debts due to business loss in the past), creditors sending court notices. I feel like commiting sucide. I am unable to bear the fact that i looked after my wife very well and she in turn is treating me harsh under her parents influence. I am cosidering filing a police case in uk saying that i am being threatened and being seperated from my child.

Please suggest.

Actually There was no invitation was made due to urgency I telephoned to my friends & told my marriage is there on so & so place please be present there
on the day of marriage my friends reached the place where i had to them by phone but there was no sign of marriage over there
This i came to know while we were moving on there hired vehicle on the way to marriage place. later I asked the driver to tell the place of marriage & he was refused to say the temple name
later he taken our party to some other place where those people arrange by themselfs without our notice

As soon as we reached the place (it was around 1.15 p.m.) I refused to get marry because my friends no one has come let them come

I sustained her harassing till one year Later I taken her to bangalore & I left her to their father's house & I served a divorce notice but they didnot repsonded anything at bangalore to 8 days after that I return back to nagpur to perform my duty.

AGain after staying one year at nagpur again she went back to bangalore now she complained in police station against my parent in dowry case The police personnel came and enquired about situation now tomorrow (18/7/2008) police called to their station & they also said if you didn't come we will come & arrest you.

As such, to soothe her anger i had taken her to my working place where we stayed in my official quarters(Bhubaneswar, also i am a Govt. Comments: I stay with my father, mother not alive and have been married for the last 15 months. Right from day one my wife started showing unhappiness over everything that I had in my home. She regularly complained, nagged, humiliated, and abused me. She always threatens to use her father's influence to avenge all of my family. Her parents also started harassing me by over this issue and that issue. Several times, her father has embarked in my home unnoticed, uncalled and has created a scene along with his daughter.

Most recently, it is just within a week of her childbirth, she started shouting & arguing with me and assaulted me at her parental house in front of her parents by strangulating my throat. Her parents have shown great deal of irrationality in justifying their daughter's behavior and attitude.

I feel highly stressed-up with her behaviour, am on the verge of losing my job, and with her threats to my life, newborn child, my father and married sisters (staying at their respective places).

Despite several times I told her and her father that she should not do all this but no result.

Please advice me what precautions and actions I should take:

1.So that she does not repeat the same things.

2.Based on her threats and actions, I apprehend she may implicate me and my other family members in false charges of dowry and other harassment. I have not accepted or received anything as articles of dowry. (On the contrary, I tried to provide her all the comforts and a decent life in my home).

My marriage was on 3rd november 2002. With a well educated girl from a
poor family, She her mother and an younger sister.Her father left from them and started to live alone when these gals re young and ultimately commited suicide. He was very evidently had some mental problems, and a well known fraud. Her mother struggled very much and with the help of her father she managed to survive with these two girls.

Very soon after marriage I hav noticd my wifes nature
very indiferent. According to my custom after marriage
the two people are onesingle unit known as the family.
But from her part its an old concept, every individual has
there own personal rigts. Her salary (just around Rs3000/-)
is her only own. Her ornaments (75 pavans) is her own property.
There is no meaning in sharing, open heartness,
real communication etc. Real eduacated people live there
life like this.

This attitude very soon developd into some kind of doubtfulness.
She afraid my parents, especially my mother going tu take her ornaments.After that she lose her mental stabilty, became very agitated, and naturally after an explosion she returned to her home.
Then I collect every single pie she took from her home and deposited
it in her own account. She was very much happy and satisfied like
a winner.

Naturally she was spenting some money for vegetables and food items.
but she believd and said to her relatives that I hav no money
and shes feeding me. For me it was an insult and after an explosion
She went home. From that moment I hav decided to consult a psychiatrist. After some time staying her home (her sister was not married at that time) she accepted my demand and suggested a name of one of her old teachers. I found him and we go for a councelling. The man concluded she is a prejudist and me a bit too sensitive. She rejected his conclusion and went home.

After some bitter experiences she came back to me as a conventional
wife. She seems a bit matured and her quarrelsome nature was changed a bit. But she need a child. She become pregnant and for 10 months her prejudices never interfered in our life. But after that they come back with more power. Now me too become an enemy. She fought with everyone, her mother sister my mom our neighbours and so and obtained lot of enemies. I never supported her furiousity so me too become a toprated enemy. At that time she accused me off trying to abuse my child. She never allowd me to place my baby on my lap. Because she is a girl. Her father had similar fantasies and he would force her mother wen these girls going school.This was the biggest blow I hav ever got (At this time I happen tu find this forum and heard bout SIF,Mr.Gokul talk to me by fone and gave me a lot off support, Thanks dear brothers) After that she got a govnt job and from then she felt shes very much powerful now could do anything she like.Then she went to her home (Now it is her sister's) on january and staying ther till now. With her moms full support to this lunatic attitude she is enjoying her life in her own way.

Now her attitude is like this. She never go for a divorce or accept it. Because she dnt like tu be a divorcee in society. If I go abroad she will be very happy. If I go for divorce she s more happy because she will become the one and only custodian and decision maker of the child, and nobody in society curse her for seeking divorce.

This is the story. I hav no other way except a divorce petition.
My doubt is the following. My relatives and my wife (thats why she is happy now) believe that Once I go for divorce and if I get it I cant interfere in the life of my child. My wife will be the sole custodian and decision maker of my baby. And she could develop her to the next generation's representative of her familie's attitudes.

My lawyer says, Custodian ship dosent mean that mother is the only respondent for a child. The baby must hav her rights to hav a father, and the father can question a bad decision in court.

IN PRACTICAL WHAT IS HAPPENING?
(My wife dont like tough games in real, So she couldnt tolerate the sufferings of a civil case,I think so)

Comments: I am having a big problem which I beleive that there is no resolution except suicide. I am sunni muslim and I have been married since 3 years. My relationship with my wife is not good from the begining of the marriage. I have a baby son who is 14 months old. I got married at the age of 23 years, because my mother is diebeatis and heart patient. So I had been forced to marry early age. I am undergraduate, but I wanted to marry a girl who should atleast complete graduation, as I was facing financial problem and I am still facing the same problem. To be honest, my wife's uncle cheated me saying that my wife is a good hard working girl etc. But she is mentally sick, she do not want to adjust with me, she do not want do any work in my house. she is not caring . She is an elder to her family, but still don't think of her, child and my future. She just want to sit ideally and want to do nothing. I have a good amount of patience and therefore, I have been waited for 3 years, hoping that one day she will become caring and hard working women. But there is no progress in these years. Whenever we fight to each other, she simply asks for divorce and I told her parents that she is asking for divorce since the time of the marriage, but they are ignoring me. They are financial good. I am working very hard to overcome of my loans. Now i have tired and decided to marry to another girl, but without divorce with my first wife, I cannot go ahead. Therefore, I request you please give some solution to my problem.

tried all my family channels (VERY URNESTLY & SINCERELY) to make her understand what is good for our child
I am still paying my insurance premiums
seeing no response I thought of going to courts
Now suddenly it seems her family is interested in negotiations
I told them:
1. Come back w child, I'll accept you if your family stops maddeling with our lives (I feel she is a good woman, but misguided by parents/sibling)
2. Otherwise I'll fight for physical & legal custody of child
3. I might ask for divorce as well

My question:
1. How do I find out if any FIR/case is made with police/court/mahila samity ASAP?
2. Do I execute a prenupital agreement before accepting her saying that in case of future separations I get the child.
3. Do I make them file any other kinds of afidevits/docs?

My bottom line: My family values are based on justice, honesty, forgiveness and patriotism, we have Gandhian freedom fighters, Shorya Chakras, army officers and teachers while their family can't think anythying other than corruption, suspicion and revange - at least I know it by now and will fight to the last ounce of my resources before letting my daughter take their culture.

Somebody please show light urgently.

i was married in 10th feb 2007, also had 1 baby 6 month yeat old,
on 30th may my mother in law came in my home, n force to my wife for come with her, n say she came back y within 5 days, so dat am agreed, hence my wife happy with me, n as such no issue between both, next day she gone to police station n complaint rgdng dowery, n also they involve my all family member, i aws shocked how can she do, but any way, finaly it comes on compromise, coz have one baby also, so dat i just keep in mind her future, but fir was logged so dat case was in court, after dat finaly she dont want to come with me, problem is dat her mother n sister does interfare in our life,
i dont know wat should i?
hence i was terminate with my current job, due to publishe in all news paper, plz help me out

Comments: an fir was lodged before the the local ps against the innocent inlaws members . the victim herself set fire on her body and died without leaving any dying declaration or suicidal notes. All the family members live in separate mess.The time of incident was 12.00 at night. The P.M. report reveals that it was a suicide but an injury was found over the sculp.Now the necessary suggession is required how to get the anticipatory bail.It is also mentioned that one of the accuseds is a govt. employee and one of the female members is carrying 3 months pregnancy.The age of father-in-law and the mother-in-law are 78 and 69 respectively.

I got married to a girl on July 12, 2000, who was living in No.9, IInd Street, Madava Nagar, Nanjikottai Road, Thanjavur-6. After which she went to her native on 01/09/2000 from then on she did not return. We called her over phone to come back but she refused using filthy languages. On 01/10/2000 they came to my native (Devakottai) home with 5 persons and took away all their things from my home. Since my father was working and my younger brother was studying at Coimbatore my motherbeing alone was only a spectator to the incident, which was witnessed by the close neighbours. At this connection we did a big mistake of not filing a complaining against them in our local police station, we did not do that only hoping to settle the issue amicably. After which, my parents had called me to come home and settle the matter amicably, when I came and called her to come back to which she refused and asked me to come and live with her in home at Thanjavur. (From then on she is asking me to come and live with her in Thanjavur).
We waited for 6 month i.e, till December 2000, periodically asking her to come back. Then, we sent a Lawyer notice just asking her to come back for which they sent reply notice using abusive language even went to an extent of telling my wife a prostitute. After which we filed the separation petition (Not a Divorce petition) in Sivaganga, which later transferred to Thanjavur by the girl’s side. In revenge to this they filed a dowry case against us, in connection to this my mother was arrested in the night and taken to Thanjavur. Against which we had complained to the National Human Rights Commission, New Delhi. Even that we had asked the police to send the girl to my working place for which the girls family disagreed and asked the police to file false FIR against my mother, me and my brother and take the matter to the court. I had to spend a lot of money to take my mother and brother on bail. Now I had to spend all money on this case and my father had to work as a security in a private company to run his family. Moreover my mother is a diabetic patient and suffers from heavy blood pressure. We can not explain our suffering caused by this case for more than 8 years. She and my younger brother are going to Thanjavur (350kms from Coimbatore-from where we abide at present) to attend the case every week.
Meanwhile they managed to get maintenance allowance of 27.5% from my salary, which is really injustice caused to me. Because ihas not agreed to sign the maintenance allowance order. Then Commanding Officer (who worked in 82 Armd Regt in the year 2000) cheated me in getting my signature. He got my signature saying that “am sending a letter to bring your wife to the unit”.
We are 100% cooperating with any one who helps us to settle the dispute amicably, for which we withdrew the divorce case filed by us at the request of existing Commanding Office of 82 Armd Regt. Even after that the girl is not taking a step forward to lead calm life. Instead we are suffering mentally spending all our time and money in the court.
We had called the girl to come and live with me through the Commanding Officer and the marriage dispute council, New Delhi but she refused saying illogical reasons (Reference: The Commanding Officer, 82 Armd Regt and Mrs. Veena Serin (Contact No.: 09810427011) â€" The Marriage Dispute Council, New Delhi). We had even called her through our Church Fathers she did not concede to live with me.
Kindly help me.we had not faced any such problems in our life.
