01. CRPC 125 - Maintainance -> Case Taken Back by Her.
02. Upper Court -> More Maintance -> Case Taken Back by Her.
03. 498A -> against me and 6 other members of my family. Case directly filed in the court -> We got a regular bail.
04. Divorce Case-> Asked huge amount of alimony and maintance from me and 6 other members of my family.
05. 498A -> With Some other charges of harasament in Thane (Maharashtra) -> Case filed , but court has not admited , neither rejected. Case is pending since 1.5 years.

My wife and my In laws are having business of marriaging a girl and then after small period file case against grooms family and taking huge amount of money from them. this is the 3 case in my wife's family. In first two they got money easily. But in my case i have not accepted their threat and fighting aginst misuse of law from last 2 years.

For harassing me and my family they have send notice and fales complaint against me, i have already loose my job. but still i am fighting. Can you please guide me what i can do to fight strongly.
As my previous Lawyer has cheated me and spoil my case. So i have changed the Lawyer. My case in running in Ulhasnager and Kalyan (Thane - District , Maharashtra).

In 2004 May she went to mother's house and did't come back. we tried to negotiate with them but was of no use.Their demand was i had to come out by leaving my widow mother who is a dependent. I approched advocate and filed divorce case in the month of Dec'2004 on the grounds of mental harassement.In the month of Jan'2005 they filed 498A, 2&3 DP act and 420 againt me and my mother.They put allegations that iam not fit for family life and harassing for dowery.At the same time they referred the case to women protection cell for the purpose of harassing me. I met concerned DIG, SP, and CI of WPC.They did't say anything to me. In the month of Feb'2005 police came and arrestedme and i got bail from the court. My divorce case was commenced in 2005June and i got divorce in Oct'2006 in favour of me. My criminal case is pending and till date i had attended four hearings. i got married in the month of Feb'2008. The petetioners are not appearing the case since then. We have filed an affidavit in the monthof feb'2008 saying that our case shoud be repealed as it was proved that the case is false based on the civil judgement and other evidences. My second wife is working in US and she is an US citizen. I want to join her as soon as possible.since the criminal case is pending there may be a problem in the process of my visa.Kindly tell me what should i do.

Then she took a job at Satna or Maihar but did not tell me her whereabouts. Meanwhile, her father insulted me several times whenever I went to his house to find about her whereabouts. This way one & half years passed. Finally, on 11.02.07 my father with my brother and uncle went to her place to bring her back after long discussion she agreed to come after a week. But even after 4 months she did not come. My father along with me, my mama and one of our family friends again went to bring her back in the month of May’06. This time she and her father finally demanded the distributions of property and Rs. 10 lacks cash for meeting the domestic expenses from the interest of this amount. Ultimately, as per our advocates advice a notice was sent to her by registered post clearly mentioning that either she should come else we will file a divorce case. This notice was retuned by her father stating that her daughter does not stay with her. Finally, on18.06.07 a divorce case was filed. On 23.07.07 she attended the first hearing. The Hon able court both the sides and asked her to stay with husband (me). She wanted time to decide Time was given but she did not appear. The next hearing was on 24.08.07; she attended the meeting and said that she is ready to come provided the divorce case is withdrawn. The court explained to her that as soon as the compromise letter is submitted the case will cease. She left the court saying that she is bringing the application. But she did not come for 3 hours. At 4.00PM her advocate submitted the application of maintenance under section 24. On 29.08.08 on Raksha bandhan day I was arrested. On 30th .08.08 she opposed my bail application and I was sent to Jail. After a week I was grated bail by the honorable D.J. Jabalpur. The next day my family members also got anticipatory bail. The charges are not yet framed by the court. However, we have filed case under IPC 482 for quashing the charges.

Comments: Got married in April 1997. Son was born in 1998. My wife was extremely bad in behaviour and would hate everyone from my family. Her mother had a remote control of her and one of the mail reasons for er to behave like that.

She ran away with the kid and all valuables on 21st Jan 2000 and since then neither of us have lived together. The total married life was of 32 months out of which she lived with me only for 9 months. I live in Faridabad and my parents and relatives are in MP. She used to live most of the time with her parents.

In October 2000, she has filed a false police complaint against me, my parents, brother and bhabhi, and sister and jijaji. She managed some injury on her body somehow and said that I have pierced a knife. Her family planned everything so meticulously they they would not fail at any level.

Anyway, with the help of relative and other senior people of society, they have agreed to withdraw the complaint by taking Rs. 6 Lacs. We signed an agreement and lived separately without any communication from any side.

Everything was okay, except, when I filed a divorce petition in Faridabad Court in March 2004, almost 4 years later of that agreement. Their family again got activated and requested the court that the same case aganist which they have taken Rs.6 Lacs be renewed.

Bhopal Court allowed the case again in July 2004 with 498A, 324, 406 of IPC, and section 3 & 4 of prohibition of Dowry Act. Later Bhopal court dismissed all other than 498A on which the case is going on since 2004 and court does not seem to be in hurry.

Here in Divorce case front in Faridabad, this lady has changed 7 lawyers, gave multiple applications in the case, filed 10-12 police complaint, tried to enter my house forcibly, went to NCW, went to Punjab and Haryana High Court and by doing wonderful dramatics, got various order in her favour. Her intention is very clear that she will harass me and not allow me to take divorce. She is getting 14000/- per months and 5000/- as court visitation money from me since she has to travel from Bhopal.

While she has been living in Delhi for over 2 and half years, court does not seem to agree to me inspite of evidences given by me. This allows her to take 5000/- for every visit. Overall I have to pay to her an average 24000/- per month. And her intent is that she carries on with the case for lifelong.

Recently she has gone to media against me. Now she has created a fictitious lady character stating that I have married this lady and have a kid. She has taken an Order from Punjab and Haryana High Court to allow amendment in Written Statement- meaning taking the case back to 4 years. Without any aspersions to anybody, the High Court judgement has disregarded even the mentioned fact. The order looked completely one-sided and pre-meditated. Police entertains so many fabricated/false and concocted complaints from her so that they can extort money from people like me. In the process my case is getting delayed and she is earning Rs. 24000/-.

On my part I am earning well and have my own house in Faridabad. I am in service in IT industry. However, I am not able to save anything for me since all money goes to her, or to lawyers or to Police.

I am disappointed, dejected and have lost faith in Indian Judiciary which just goes on woman side.

I have become a strong person and certainly would like to do something to my fellow sufferers once I get out of this mess of my life which is in full steam at 11th year.

Please help and advice me.

Suddenly on 23rd May a phone call came from my wife native, telling about her character and her past. They have also threatened about my life. They told that we have some snaps & cd’s of my wife contains nudity. They demanded RS 20,00,000.00 for that. As I am the only son of my parents they where in great shock and worry. My father called my father-in-law and told the entire things about the phone call.

After that they called me and my wife back to M.P. After reaching home we got a phone call from my in-laws that my father-in-law is critical. So my father mother & wife gone there to see him. After reaching home my wife refused to came back.

Actually the phone call was made by the employer of my wife; she has an illegal relation with him from last 5 years. He is 45 year old and already married having 3 children. He just wants to break her marriage to get her back. He told indirectly my father every thing and my wife confirms all those things. He planed every thing to break our marriage; he made a huge friction between our families.

After all those things got opened my wife simply refused to live with me, but I really don’t want to give divorce. But her previous employer made some pressure or some thing else they just forcing us to sign divorce. When I refuse to do this then they start threatening to file dowry petition. They use to call us and threatened us to file FIR and Case against us.

On 10th July 2007 I have filled a case against my wife under section 9 hindu marriage act to get her back. After that I had tried my level best to avoid divorce, I use to call her frequently to assure that every thing would be fine. I had gone twice to my wife’s home to take her back but not succeeded.

After few months my in-laws call my father and request that my wife is not willing to go back so it would be better for both of us to file Divorce Mutually under section 13. So we have gone there to file Divorce under mutual concern. But they have already filled a case against section 14 for divorce. They have mentioned lots of physical and mental harassment against me and attempt of rape against my father and on these ground they want divorce. They want me to sing no objection to precede this case, I simply refuse that. And we came back.

After some time we got to know that they have filled 1 more case under section 125 demanding RS 30,000.00 per month. In thins case they have mentioned same allegations
And they have also mentioned about the notice of our case under section 9 as false case.

This is my brief case history.

Some important things:

We have filled case under section 9 on 20th July 2007.

They have got notice of this case on 11th Jan 2008 they mentioned it on there section 125 case.

They have filled case under section 125 on 14 Feb 2008.

They have filled case under section 14 & 13 on 15th Feb 2008

They are not responding to our section 9 case so we are hoping to got Ex-Party order soon.

Till now we have not got any notice of there case so we are also not responding.

Basically I am very simple and emotional boy having extremely clean habit. From last 1 year I am facing acute mental trauma & huge finically setback due to lack of concentration at work. Some time I think do commit suicide.

So I need a suggestion regarding our next course of action.

From bottom of my heart I still don’t want divorce, is there is some body which can help me to save my marriage life. For this we have to do some thing about my wife employer.

Now wifes demand is as below in court:-
(1) They want all jewellery which were given from our side at the time of wedding by saying it is STREE DHAN.

(2) Wife is asking for maintenance & House Rent.

(3) How to proove that she is working as they are claiming that before she was working and now she is studing.

(4) They have filed case after 15 months is this valid?

(5) I will have to give maintenance, Rent,Stree Dhan etc....

Comments: My wife filed for divorce stating mental and physical torture in Dec 2001 at Family Court at Kolkata. Case dragged on for 5 years and she could not prove her allegations. Just before the family court could give divorce order, she moved high court and got the case transfered. Then again in 2007 she got the case moved back to family court. Now for over a year there has been no judge so all we get are new dates.

Today there was a hearing and thru another councelor she has sent a threat to me that they will file criminal complain against me. Please note so that there were no lawyers from both parties since the family court said both are educated and can make own case. My wife and I have been living apart for the last 7 yeast. She in Kolkata and I in Bangalore. Please advise if she can invoke any section of 498a against me after all these years and if so what can I do in anticipation of the same.

Right now case is in women cell delhi. two meetings failed. We could not agree on amount.
There are two problems. Huge amount of settlement amount in laws are demanding.
Lawyers are not ready to believe it was dowry less marriage. They are not even ready to take our case. All advising go for mutual.
they are saying even supreme court will do the same.

Comments: my wife was diagnosed with multiple uterine fibroids each of 8-9 cm diameter just 1 week after marriage and she told me that she was not aware of it. i believed her and on advise of doctor took her to bangalore where check up at at manipal hospital,st john's hospital and apollo hospital was done. all doctors advised that it would be very difficult for her to get pregnant and even if she does abortion may need to be done even during the 6th month of pregnancy. however doctor at manipal hospital took responsibility of providing best care so that we could have baby. my delivered wife a boy on25/01/08. during our stay at bangalore i was doing all the household chores from washing her and my clothes,cooking food, taking her to hospital and my parents and brother was bearing the entire expense of around 20-25 thousand rupees per month.hospital expenses for delivery from admission till discharge was paid by both the families. during our stay my mother in law came during 8th month of pregnancy of her daughter to take care of her. instead of taking care of her daughter she was shouting ,yelling and humiliating me in front of the rest of the tenants and landlord of the apartment. after discharge from hospital my wife went back to her parents home. she came to stay with me after couple of days but after every 7 to 8 days she started to harass me and my parents and she went back to her parents home. her parents would come each time, make a lot noise in my place of residence and threaten us of filing dowry harassment,mental and physical torture case aginst us. she came and went back to her parents 3 times in less than 40 days . we submitted an advocate notice to the stating the entire facts and asking them to ask her daughter to live peacefully with me but instead they have sent a legal notice that they will file harassment case against us and put all of us behind bars.we also submitted an informatory petition stating the entire facts to DIG ,SP and police station of both place ie place of her and my residence.
she has also taken away all her jewelllery,my mother's jewellery and some cash that was kept in the almirah safe in my bedroom.my father and mother both are above 65 years and my father is a pensioner under bihar govt.my brother is an NRI and send huge sums of money each month in my account each month. we also earn 8-10 thousand through rent from our house.we have never demanded any form of dowry either in cash or kind either before or after marriage. whatever was given was by their own sweet will.we are even ready to return back each and every penny and all gifts given by them as we never was interested in dowry. the child is also with her at her parents home. please advise what to do and how can i save my married life? she is also demanding maintenance for her and the child. another important fact is that her elder sister who has been married since over ten years and has a daughter of about 9 years is living with her parents for past ten years with her parents and not with her husband. i am not certain but i have to come to know that her husband is living in canada and is married and has children in canada and that he is paying maintenance to his first wife ie my wife's elder sister in india . they have not tken any divorce or judicial seperation. i have also come to know from her nieghbours that my also suffers from epilepsy and she had and epileptic convulsions in labour room in manipal hospital during labour pain on the day before she delivered the baby ie 25/01/08
